R (on the application of Wandzel) v Secretary of State for the Home Department

Immigration – Deportation. The defendant Secretary of State's certification that it would not breach the claimant Polish national's rights under the European Convention on Human Rights to deport him before the commencement or final determination of his appeal against deportation was proportionate, fair and lawful. The Administrative Court, in dismissing the claimant's application for judicial review, further held that his immigration detention was, at all times, lawful.
