R (on the application of Tainton) v HM Senior Coroner for Preston and West Lancashire

Coroner – Inquest. The Divisional Court held that the defendant coroner had not erred in law by not having left to the jury the question whether, on the balance of probabilities, the admitted failure of medical care had significantly hastened a serving prisoner's death. However, the coroner should have directed the jury to include in the record of inquest a brief narrative of the admitted shortcomings of the health care staff responsible for the late diagnosis.
