Town and country planning – Permission for development. The Administrative Court allowed the claimant's application for judicial review of the defendant local planning authority's grant of planning permission and listed building consent to alter a listed building, which included the construction of a substantial basement underground. The authority had approached the case with the erroneous mindset that it could not refuse permission for something which had, in large part, already been approved and it could not be concluded that, had it approached its duties in accordance with the law, the outcome would have been the same.
