R (on the application of Sivayogam) v Secretary of State for the Home Department

Immigration – Workers. Notwithstanding the defendant Secretary of State's conceded error in her decision to revoke the claimant's Tier 2 and Tier 5 sponsor licence, by having concluded that the claimant had failed to provide the requested hierarchy of workers, relief was refused. The Administrative Court held that it was highly likely that the outcome for the claimant would not have been substantially different if the error had not been made, in that the sponsor licence would have been revoked in any event.
