R (on the application of Silvera) v Her Majesty's Senior Coroner for Oxfordshire

Coroner – Inquest. The defendant Senior Coroner should have taken a decision to resume the inquest into the death of the claimant's mother. The Divisional Court held that his decision not to do so had been unlawful and in breach of both the obligations under art 2 of the European Convention on Human Rights and the common law obligations to do so, as criminal proceedings and two internal investigations had not satisfied the requirements.
