Town and country planning – Permission for development. The relevant parts of the 2001 green paper constituted as an express promise that reasons would be given for decisions not to call in an application under s 77 of the Town and Country Planning Act 1990. That promise was reiterated in 2012 and was not withdrawn or modified. The Court of Appeal, Civil Division, held that in consequence, those events gave rise to a legitimate expectation, that had not been withdrawn, that reasons would be given for non-intervention.
