R (on the application of Rose) v Secretary of State for Justice

Sentence – Life imprisonment. Whilst oral hearings in the context of categorisation reviews would be comparatively rare, all save one of what were described in Prison Service Instruction PSI 08/2013 as important factors tending in favour of an oral hearing were squarely in play in the present case. Accordingly, the Deputy Director of Custody High Security decision not to hold an oral hearing in the claimant serving prisoner's case had been unlawful.
