The judge had erred in having applied the same principles as applied to costs to the award of compensation under the Anti-Social Behaviour, Crime and Policing Act 2014 s 90 on the basis that there would also be financial prejudice to the police if compensation were awarded. However, the Administrative Court held that she had been correct to consider that any challenge to the validity of the closure notice had been a matter for judicial review and not within the magistrates' court jurisdiction.
