The claimant Pakistani national's proposed evidence was not capable of having any decisive effect in the present case and the defendant Secretary of State could not be regarded as having acted unfairly. Accordingly, the Upper Tribunal (Immigration and Asylum Chamber) dismissed the claimant's application for judicial review of the Secretary of State's decision to curtail his leave to remain as a student on the basis that he had engaged in deception.
