R (on the application of Miah) v Secretary of State for the Home Department

Immigration – Removal. The defendant Secretary of State's decision to remove the claimant Bangladeshi national on the basis that the documents he had presented had been shown to be unreliable was unlawful and would be quashed. The Administrative Court held that a 2002 Immigration Tribunal determination revealed that the assumption the Secretary of State had relied on had been false, such that the basis for the removal decision, and her defence, was untenable.
