R (on the application of Lensbury Ltd) v Richmond-Upon-Thames London Borough Council

Town and country planning – Permission for development. The Court of Appeal, Civil Division, held that the defendant local planning authority had erred in granting planning permission for the installation of a three-turbine hydro-electric generation facility, where its planning policy had specifically stated that developments in metropolitan open and ought to be treated the same as if the development fell within Green Belt land, but the authority had failed to apply the same strict restrictions as applied to Green Belt developments.
