Town and country planning – Permission for development. The Planning Court dismissed the claimant's application for judicial review of the defendant local planning authority's decision to grant planning permission for the construction of 377 dwellings. The authority had not failed to comply with s 66(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990 or the exceptions by which the presumption in favour of sustainable development might be disapplied and its reason for deciding that the application should not be referred back to the committee after receipt of a report was accepted.
