The carefully crafted information which the interested party had been put forward had failed to comply with the duty of candour and the non-disclosure would have made a difference to the defendant court's decision. Accordingly, the Divisional Court allowed the claimants' application for judicial review of the defendant's refusal to dismiss summonses for offences of fraud issued against the claimants and to stay the proceedings as an abuse of process.
