The Divisional Court held that the defendant local authority's proposal to close a Welsh language school and an English-Welsh language school, and replace them with a dual language school over the existing sites of those schools, with an intention to subsequently build a new school at a new site, was unlawful. The authority's consultation document had only considered the impact upon the language and community in regard to the creation of the new school, and had failed to consider the long-term impact on language and the community of the proposal as a whole.
