R (on the application of Jayeola) v Secretary of State for the Home Department

Immigration – Detention. The Administrative Court held that the claimant (C) had been unlawfully detained for the last two days of his immigration detention period between 25 September and 8 October 2015. In the circumstances, there had been independent evidence that C had been tortured, but exceptional circumstances which rendered the period up to and including 28 September as lawful because C had been scheduled for removal on 29 September. The reasonable period for the Home Office to consider C's claim form had expired on 6 October, which was when C should have been released.
