R (on the application of Hayes) v Crown Prosecution Service

Criminal evidence – Prosecution evidence. The defendant Crown Prosecution Service Victims' Right to Review Guidance was, or was operated as, an inflexible policy in a case concerning its decisions to offer no evidence in all proceedings relating to the victim. However, the Divisional Court, in dismissing the claimant's application for judicial review, held that it was not unlawful, as its restriction was justified and proportionate in its balancing of competing interests.
