Local authority – Councillor. The defendant local authority's reliance on the Local Government Act 1972 powers, in placing a number of restrictions on the claimant local councillor following a complaint about her conduct, and continuing and enlarging those restrictions, had been misplaced. The Administrative Court, in allowing the claimant's application for judicial review, held that at least the sanctions element of the defendant's decision should have taken place via the process under the Code of Conduct for Councillors and the action taken had been ultra vires.
