The Court of Appeal, Civil Division, dismissed the claimant's appeal against the judge's refusal of her application for the costs of her judicial review proceedings against the defendant First-tier Tribunal (Immigration and Asylum Chamber) to be paid by it. The court was bound by authority that costs would only be ordered against a tribunal if there had been a flagrant instance of improper behaviour on its part and the claimant put too much weight on subsequent authority that a judicial review claimant who obtained the relief which he sought should normally be awarded his costs.
