R (on the application of Goldsworthy) v Secretary of State for Justice

Prison – Release on licence. There had been no justification for the claimant's detention, which had been unlawful from the time of his recall to prison, as the reasoning for the decision had failed to take account of obviously relevant considerations and to apply the defendant Secretary of State's own policy guidance. Accordingly, the Administrative Court allowed the claimant's application for judicial review, and quashed the recall decision and its subsequent reaffirmation.
