R (on the application of Faraday Development Ltd) v West Berkshire Council

Local authority – Land. The Administrative Court dismissed the claimant's challenges to the defendant local authority's decision to enter into a development agreement with the interested party to facilitate the comprehensive regeneration of an area of land of which the authority was the freehold owner. The authority had not failed to comply with its duty to obtain the best consideration reasonably obtainable, the development agreement was not a 'public contract' and the decision had not been irrational.
