Immigration – Detention. The claimant Nigerian national had been unlawfully detained from 14 March 2017 until her release on 14 April 2017, as the defendant Secretary of State had failed to take into account her attempts to leave the United Kingdom voluntarily, thwarted by the Secretary of State's failure to provide her passport. The Administrative Court further held that the case was not one in which the claimant's measure of recovery was limited to nominal damages, as the Secretary of State had not demonstrated that the decision to detain would have been lawful if the relevant matters had been considered.
