R (on the application of Dowley) v Secretary of State for Communities and Local Government

Town and country planning – Inquiry. The Administrative Court dismissed the claimant's application for judicial review of the defendant Secretary of State's decision, authorising the interested party to enter onto the claimant's land for the purpose of site investigation prior to the construction of a new nuclear power station, under s 53 of the Planning Act 2008. Its reasons included that the statutory scheme did not grant the Secretary of State any power to deal with compensation as sought by the claimant.
