R (on the application of Conway) v Secretary of State for Justice

Criminal law – Suicide. The Divisional Court refused the claimant permission to proceed with judicial review proceedings for a declaration that s 2(1) of the Suicide Act 1961, criminalising assisted dying, was incompatible with his rights under arts 8(1) and 14 of the European Convention on Human Rights. It was not arguable that a declaration of incompatibility should be made, in the light of the post-R (on the application of Nicklinson and another) v Ministry of Justice; R (on the application of AM) v Director of Public Prosecutions ([2014] 3 All ER 843) parliamentary consideration of the very difficult moral issue.
