Discrimination – Disability discrimination. The defendant Secretary of State succeeded in showing that the cap on the amount of payments made under a discretionary assistance scheme established under statutory powers to help people with disabilities to work had been a proportionate means of achieving a legitimate aim, within s 19(2)(d) of the Equality Act 2010. Accordingly, the Administrative Court held that the claimant's indirect discrimination ground of challenge, though arguable, was defeated by the success of that defence.
