R (on the application of Bowen and another) v Secretary of State for Justice

Prison – Release on licence. The Administrative Court held that the defendant Secretary of State was not under any duty to release a life prisoner the moment the Parole Board had directed release, but was only obliged to release in a case where an approved premises was specified as a condition of release once that approved premises was available for the particular prisoner, and not before. Therefore, the claimants had not been unlawfully detained.
