R (on the application of Anugha) v Secretary of State for the Home Department

Immigration – Detention. The Administrative Court, in partially allowing the claimant Nigerian national's application for judicial review of her immigration detention, held that the defendant Secretary of State had failed to comply with her published policy by not referring the claimant for an assessment as quickly as possible following her having raised an allegation of torture. However, the same period of detention would inevitably have occurred and the claimant was only entitled to nominal damages.
