R (on the application of Akturk) v Secretary of State for the Home Department

Immigration – Leave to remain. The Administrative Court allowed the claimant Turkish national's application for judicial review of the defendant Secretary of State's decisions, refusing him leave to remain in order to establish himself in business. The defects in the initial decision had not been corrected or cured by the administrative review, and the replacement of the statutory right of a judicial appeal by administrative review was incompatible with the EEC-Turkey Association Agreement.
