Immigration – Detention. There was nothing to suggest that those making the decisions to maintain the claimant's detention had addressed their minds to Ch 55.10 of the Enforcement Instructions and Guidance, such that he had been unlawfully detained. However, the Administrative Court held that, there was no doubt that the claimant would have been detained lawfully and he was entitled to nominal damages only.
