The first claimant Gambian national's removal had been unlawful as it had been made on the basis of a fundamentally flawed decision, particularly because the defendant Secretary of State had failed to undertake the approach to his new submissions made with anxious scrutiny and had failed to take into account all the relevant facts. The Administrative Court, in allowing the claimants' application for judicial review, further held that the first claimant had been unlawfully detained from 10 November until his removal on 19 November 2016.
