National Health Service – Duty to provide healthcare services. The defendant Secretary of State's NHS Blood and Transplant (Gwaed a Thrawsblaniadau'r GIG) (England) Directions 2005, prioritising those ordinarily resident in the United Kingdom in the allocation of organs, were not ultra vires. The Divisional Court held that the Secretary of State's power to give directions to the interested party under National Health Service Act 2006 ss 8 and 272(7) was not limited by any provision other than s 1 and the Directions were not in conflict with that target duty.
