Progas Energy Ltd and others v Islamic Republic of Pakistan

Arbitration – Costs. The defendant Republic of Pakistan's application for security for costs succeeded in part, in a dispute concerning the provision of liquefied petroleum gas. The Commercial Court considered the situation where funding of a party to litigation was provided by a third party that had not contracted to accept responsibility for the claimants' adverse costs, but had stated that it would ensure that its subsidiary paid those costs.
