Nurse – Professional conduct – Fitness to practise. Court of Session: Refusing an appeal against a decision of the Nursing and Midwifery Council's Conduct and Competence Committee, which found that a nurse was guilty of misconduct but that her fitness to practise was not impaired, the committee having no power to impose a penalty in respect of the misconduct in the absence of a finding of unfitness, the court rejected the contention that the committee's decision was insufficient for the protection of the public and that a finding of unfitness should have been made and a sanction imposed.
