Criminal evidence – Sexual offences – Admissibility of evidence. Sheriff Court: In an application by a person accused of charges of communicating indecently, seeking permission to elicit chapters of evidence as an exception to the restrictions on evidence relating to sexual offences, the court allowed admission of one of the proposed chapters of evidence, holding that it met the cumulative test set out in s 275(1) of the Criminal Procedure (Scotland) Act 1995, but refused the application in respect of the other four chapters of evidence as they failed the test.
