Employment – Unfair dismissal. The employee, a prison officer, had been dismissed after allegedly using physical force on a prisoner. The employment tribunal held that the dismissal had been unfair. The Employment Appeal Tribunal, in allowing the employer's appeal held that, to the extent that there had been a failing in the disciplinary investigation concerning the employee, it had not rendered his dismissal unfair, because the decision had not been based on the prisoner's account, but on what could have been seen on the CCTV recording.
