Trust and trustee – Constructive trust. The Queen's Bench Division dismissed the claimant's appeal against the judge's refusal to declare that the defendants held property on constructive trust or, alternatively, by reason of proprietary estoppel. The judge had been correct to determine that there had been no properly construed agreement between the claimant and the defendants for the property, and that, in any event, the agreement could be set aside as it had been procured by undue influence.
