Pillar-Neumann v Public Prosecutor's Office of Klagenfurt

Extradition – Extradition order. The defendant successfully appealed against her extradition to Austria in relation to offences of professional and severe fraud and embezzlement in circumstances where the extradition process had commenced over 13 years prior to the present proceedings. The Administrative Court held that in all the circumstances it would be oppressive and unfair to extradite the defendant given the passage of time, notwithstanding the seriousness of the alleged offending pursuant to the Extradition Act 2003.
