Industrial relations – Collective bargaining. The Court of Appeal, Civil Division dismissed an appeal by the Pharmacists' Defence Association Union against a decision dismissing its application for a declaration of incompatibility pursuant to s of the Human Rights Act 1998 in relation to recognition for bargaining purposes in accordance with the procedures under Part I of Schedule A1 to the Trade Union and Labour Relations (Consolidation) Act 1992. The court held that art 11 of the European Convention on Human Rights had not conferred a universal right on any trade union to be recognised in all circumstance to be recognised for collective bargaining against the wishes of the employer, and given that it had been open to PDAU to procure the de-recognition of the BPA, no breach of art 11 of the Convention had arisen in the instant case.
