The Court of Justice of the European Union gave a preliminary ruling, deciding, in essence, that arts 2 and 6(2) of Council Directive (EC) 2000/78 had to be interpreted as meaning that a national rule, such as that at issue in the main proceedings which, in connection with an occupational benefit scheme, made the right of surviving civil partners of members to receive a survivor's benefit subject to the condition that the civil partnership had been entered into before the member reached the age of 60, where national law had not allowed the member to enter into a civil partnership before reaching that age limit, did not constitute discrimination on grounds of sexual orientation or age.
