Civil procedure – Contempt of court. Court of Session: In an application by the Panel on Takeovers and Mergers, asking the court to find the respondent guilty of contempt of court by reason of his failure to obtemper an interlocutor, the court rejected arguments that the Panel's application was incompetent because it was obliged to obtain the Lord Advocate's concurrence to the raising of the proceedings and had failed to do so, and that proceeding by minute was incompetent and the application required to be by petition and complaint to the Inner House.
