Shipping – Charterparty. The Commercial Court dismissed the claimant company's claim, which arose out of the failure of the first defendant, UHK, to meet the requirements of shipping cargoes as set out in a contract between the parties. The court held that English law applied to the contract, and UHK was not liable for breach of an implied in law promise to perform the contract and not to do anything improper or unjustified. Further, there had been no interference with an established contractual right and no breach of the relevant brokerage agreement.
