Judicial review – Social care – Duties of local authorities. Court of Session: Dismissing two related judicial review petitions in which the petitioner sought remedies in respect of a local authority's alleged failures to perform their statutory duties towards his 86-year-old mother, Mrs Q, the heart of the dispute being whether the respondents were required to pay for 24-hour one-to-one care at home, or whether Mrs Q's needs could be provided for in a nursing home, the court concluded that the respondents had not failed to perform their statutory duty towards Mrs Q under s 12A of the Social Work (Scotland) Act 1968 in respect of a Support Needs Assessment, nor had they failed to perform their statutory duty towards her under ss 4 and 5 of the Social Care (Self-directed Support) (Scotland) Act 2013.
