The agreement between the appellant solicitors' firm specialising in personal injury litigation and the respondent insurance intermediary did not amount to a promise or an obligation to refer a quantity of claims or any claims. The Court of Appeal, Civil Division, in dismissing the appellant's appeal, held that the agreement was merely an expression of a present intention, and the clause as a whole was a description of the intended referral relationship if and when claims were referred.
