Limitation of action – Extension of time limit. The Court of Appeal, Civil Division allowed an appeal by the claimant in relation to a decision in a slander case not to disapply the primary limitation period under s 32A of the Limitation Act 1980. The reality was that the case had not been brought out of time, and given that the hearing had been conducted on the incorrect basis, that was reason enough to disapply the primary limitation period.
