Insolvency – Property available for distribution. None of the respondents had the benefit of any valid defence to the claimants' claim, under s 127 of the Insolvency Act 1986, that payments received between the date a petition was presented and the date a company entered compulsory liquidation were void and had to be returned to the company. Accordingly, the Chancery Division held that the claims succeeded against each of the respondents concerned.
