O'Neil v O'Neil and another

Succession law – Lifetime gift – Title to sue – Undue influence – Facility and circumvention. Sheriff Court: Dismissing an action in which the pursuer sought reduction of a love, favour and affection disposition by his mother of her house to two of his brothers 21 months prior to her death, the court was satisfied that the pursuer had title to sue, however it held that his pleadings failed to set out a relevant basis for reduction by reason of lack of specification of undue influence or facility and circumvention.
