European Union – State aids. Article 1(7)(c) of Commission Regulation (EC) No 800/2008 should be interpreted as meaning that the concept of 'collective insolvency proceedings' that it referred to covered all collective insolvency proceedings for undertakings provided for by national law, whether they had been opened by the national administrative or judicial authorities of their own motion or on the initiative of the undertaking concerned. The Court of Justice of the European Union so held in a preliminary ruling in the course of proceedings between Nerea SpA and the regione Marche (Le Marche, Italy), concerning the withdrawal of state aid granted to Nerea on account of the admission of that company to an arrangement with creditors as a going concern.
