Design – Design right. The amendment, by the Intellectual Property Act 2014, to remove 'any aspect of' a design from s 213(2) of the Copyright, Patents and Designs Act 1988 was not fully retrospective in that it did not extinguish accrued rights of action for infringements, which had occurred prior to 1 October 2014. So held the Patents Court in dismissing the claimant's claim for infringement of a Community registered design and unregistered design rights in respect of kitchen furniture.
