Champerty – Defence. The Commercial Court ruled on applications made by the defendant company to, among other things, strike out a claim against it. The court held that the claimant company, which was not represented, had been entitled to delegate the service of documents to a company providing assistance to it. Further, on the evidence, although the defendant had raised good points that the claim should be struck out for maintenance/champerty, they were insufficient to lead to summary judgment at the present stage.
