Immigration – Deportation. In the first appeal, the Court of Appeal, Civil Division, dismissed the appellant Nigerian national's appeal against the decision by the Upper Tribunal (Immigration and Asylum Chamber) (the UT), upholding orders for his deportation, as the UT's determination had not been affected by any material legal error. However, in the second appeal, it allowed the appellant Secretary of State's appeal against the UT's decision allowing the respondent Ugandan national's appeal, as the various points added up to the clear conclusion that the UT had erred materially in law in having reached its decision.
