Limitation of action – Personal injury claim. The master had properly exercised his discretion to allow the claimant's claim against the defendant for failure to obtain proper informed consent to surgery to proceed, under the Limitation Act 1980 s 33, although brought outside the limitation period. The Queen's Bench Division further held that the master's order for the defendant to pay the claimant's costs of the preliminary issue of limitation had been entirely appropriate and open to him in the exercise of his discretion.
